Terms and Conditions
These Terms and Conditions govern your use of TapCharge power bank rentals, kiosks, websites, web apps, accounts, payment features, support, and SMS messaging.
Acceptance of terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between Gao Technologies LLC, doing business as TapCharge ("TapCharge," "we," "us," or "our") and any individual or entity that accesses or uses the TapCharge services ("you" or "User").
These Terms govern your access to and use of TapCharge's power bank rental services, kiosks, websites, web applications, mobile interfaces, payment features, customer support services, and any related products or services (collectively, the "Services").
By accessing or using any part of the Services, including scanning a QR code, initiating a rental, creating an account, submitting payment information, or using a TapCharge power bank, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies that may be incorporated by reference.
If you do not agree to these Terms, you must not access or use the Services.
TapCharge reserves the right to modify, suspend, or discontinue any portion of the Services at any time, subject to applicable law.
TapCharge service
TapCharge provides shared portable power bank rentals through kiosks and related web app features. You may scan a QR code, select a rental, authorize payment, remove a power bank, and return it to an eligible TapCharge kiosk.
Availability of kiosks, power banks, charging ports, app features, payment options, coupons, credits, and support tools may vary by location and time.
The Services may also include payment processing, rental history, account management, customer support, notifications, promotional offers, and other features that TapCharge may introduce from time to time.
TapCharge strives to maintain the availability and functionality of its Services. However, we do not guarantee that every kiosk will have available power banks or return slots, or that all features will be continuously available. Services may be limited, suspended, or temporarily unavailable due to maintenance, technical issues, network interruptions, inventory shortages, safety concerns, or other operational reasons.
Accounts and verification
Some features may require an account. You agree to provide accurate information, keep your login credentials secure, and promptly update your information if it changes.
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. If you believe your account has been accessed or used without authorization, you must notify TapCharge promptly. TapCharge is not responsible for losses resulting from your failure to safeguard your account credentials.
TapCharge may require phone number verification, email verification, payment verification, or other checks before allowing rentals, deposits, refunds, coupons, account credits, or other features.
If you provide false, inaccurate, incomplete, or misleading information, or if TapCharge reasonably suspects fraudulent or unauthorized activity, TapCharge reserves the right to refuse service, suspend or terminate your account, cancel rentals, or restrict access to certain features, to the extent permitted by applicable law.
Rentals, returns, and fees
Rental pricing, deposit or authorization hold amounts, maximum rental charges, late fees, replacement fees, and other charges will be shown in the app or at checkout before you confirm a rental.
Based on current TapCharge plans, a rental may include a payment authorization hold, time-based rental fees, a session maximum, and a charge for unreturned power banks. Final pricing may vary by location, promotion, or checkout screen.
You are responsible for returning the same power bank in good condition to an eligible TapCharge kiosk. If a power bank is not returned, is returned late, is damaged, or is not detected as returned, you may be charged as disclosed at checkout.
You are also responsible for exercising reasonable care while the rented power bank is in your possession. The power bank should be used only for its intended purpose and in accordance with any instructions provided by TapCharge.
Damage resulting from misuse, unauthorized disassembly or modification, water exposure, crushing, improper handling, or other abnormal use may result in repair or replacement charges as permitted by applicable law and as disclosed in the applicable pricing policy.
A power bank will be considered returned only after it has been successfully accepted and recorded by an eligible TapCharge kiosk. Until the return is successfully recorded in our system, you remain responsible for the rented equipment and any applicable rental charges.
TapCharge may rely on kiosk records, system logs, transaction records, and other operational data to determine rental status, return status, and applicable charges, subject to applicable law.
If you believe a charge, rental duration, return status, or kiosk issue is incorrect, contact TapCharge support as soon as possible so we can review the rental records.
Payments, holds, and refunds
You authorize TapCharge and its payment processors to place authorization holds, charge rental fees, collect deposits, process account balance transactions, issue refunds or credits, and collect other amounts you owe under these Terms.
Payment authorization holds are not final charges, but they may reduce your available balance until released by your bank or payment provider. Release timing is controlled by your financial institution.
Refunds and credits are provided at TapCharge's discretion unless required by law. TapCharge may review kiosk records, payment records, support messages, and fraud-prevention signals before issuing a refund.
If a payment method is declined, expires, is canceled, or otherwise becomes unavailable, you agree to promptly provide a valid alternative payment method upon request. TapCharge may suspend or limit your access to the Services until all outstanding amounts have been paid.
To the extent permitted by applicable law, TapCharge reserves the right to collect any unpaid rental fees, replacement costs, damage fees, late fees, or other amounts owed under these Terms using the payment method designated for the applicable rental or any other payment method associated with your account.
If you believe that a charge or transaction was made in error, you should contact TapCharge support as soon as reasonably possible. TapCharge may request additional information or documentation and review relevant kiosk records, transaction records, and other operational data before determining whether a refund or account credit is appropriate.
Any promotional credits, coupons, discounts, or other incentives offered by TapCharge are subject to their applicable terms and conditions and may be modified, suspended, or discontinued at any time, unless otherwise required by applicable law.
SMS terms
By providing your mobile number and agreeing to receive texts, you consent to receive SMS messages from Gao Technologies LLC d/b/a TapCharge related to account verification, rental confirmations, return reminders, payment notices, customer support, service updates, and other TapCharge service messages.
Message frequency varies based on your account and rental activity. Message and data rates may apply. Consent to receive SMS messages is not required as a condition of purchase except where a text message is necessary for account verification, security, or completing a requested service.
You can opt out at any time by replying STOP. After you send STOP, we may send one confirmation message. You can reply HELP for help or contact support@tapcharge.app.
Carriers are not liable for delayed or undelivered messages.
Acceptable use
You agree not to misuse TapCharge, interfere with kiosks or software, attempt unauthorized access, bypass payment or verification systems, provide false information, damage or tamper with power banks, use TapCharge for illegal purposes, or help anyone else do so.
TapCharge power banks must be used only for their intended purpose and in accordance with any instructions provided by TapCharge. Users are expected to exercise reasonable care while the equipment is in their possession and must not intentionally or negligently damage, dismantle, modify, deface, or misuse any TapCharge equipment.
Users must not remove, alter, obscure, or tamper with any labels, serial numbers, QR codes, security features, or other identifying markings on any TapCharge kiosk or power bank, nor may they interfere with the normal operation of the Services or attempt to circumvent any security or payment mechanism.
Any loss, theft, intentional damage, unauthorized modification, or other misuse of TapCharge equipment may result in additional charges, suspension or termination of the user's account, recovery of losses, and any other remedies available to TapCharge under applicable law.
TapCharge may suspend or restrict access, cancel rentals, refuse refunds, or pursue recovery of losses if we believe there is fraud, abuse, nonpayment, damage, or violation of these Terms.
Third-party services
TapCharge may rely on third-party services for payments, wallet payments, maps, hosting, analytics, messaging, fraud prevention, and customer support. Those services may have their own terms and privacy policies.
TapCharge may also work with third-party venue operators, merchants, property owners, distributors, and other business partners to provide or facilitate the Services. The availability, operation, and accessibility of TapCharge kiosks at certain locations may depend on such third parties and their business operations.
TapCharge is not responsible for the products, services, policies, acts, or omissions of any third party unless otherwise required by applicable law. Any interactions or transactions between you and a third party are solely between you and that third party, although TapCharge may, at its discretion, assist in reviewing or resolving issues relating to the Services where appropriate.
Disclaimers
TapCharge is provided on an as-is and as-available basis. We do not guarantee that every kiosk will have available power banks, open return slots, uninterrupted connectivity, or error-free operation.
To the maximum extent allowed by law, TapCharge disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
The availability and performance of the Services may be affected by maintenance, repairs, software updates, network interruptions, power outages, equipment failures, inventory shortages, acts of third-party service providers, or other operational circumstances. TapCharge does not guarantee that the Services will be uninterrupted, timely, secure, or free from errors.
TapCharge may suspend, limit, or temporarily discontinue all or part of the Services for maintenance, upgrades, safety concerns, or other legitimate business or operational reasons without liability to the extent permitted by applicable law.
TapCharge is not responsible for delays, interruptions, or failures resulting from events beyond its reasonable control, including but not limited to natural disasters, severe weather, war, terrorism, civil unrest, government actions, labor disputes, widespread communication failures, or other force majeure events.
Users are responsible for following the instructions and reasonable safety guidance provided for the use of TapCharge equipment. Except as required by applicable law, TapCharge is not responsible for losses or damages resulting from a User's misuse of the Services, unauthorized modification of equipment, or failure to follow such instructions.
Limitation of liability
To the maximum extent allowed by law, Gao Technologies LLC d/b/a TapCharge will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption.
To the maximum extent allowed by law, TapCharge's total liability for claims related to the service will not exceed the amount you paid to TapCharge for the rental or transaction giving rise to the claim.
To the maximum extent permitted by applicable law, TapCharge will not be liable for losses or damages arising from the unavailability of kiosks, network or communication failures, delays in payment processing, acts or omissions of third-party service providers, force majeure events, or a User's misuse of the Services or failure to follow provided instructions. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
Changes to these terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of TapCharge after changes become effective means you accept the updated Terms.
Where required by applicable law, TapCharge may provide additional notice of material changes through the Services or by other reasonable means. You are responsible for reviewing these Terms periodically to stay informed of any updates.
Your continued access to or use of the Services after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue your use of the Services.
